Terms & Conditions of use for posting and participating on the JobnLaw platform

 

This Terms & Conditions of use is a binding agreement between the visitor and-or user of the Jobnlaw.com website (You) and JobnLaw and Harilex inc., owner and operator for the JobnLaw.com platform, (JobnLaw) . Terms and conditions are deemed accepted by You at anytime that you enter or use the JobnLaw platform (Website) or any of JobnLaw services. If you do not wish to be bound by this agreement, do not use the JobnLaw website. Terms and conditions of this agreement may be subject to change at anytime and become effective immediately. These Terms and conditions include the JobnLaw Privacy Policy, which is incorporated into these Terms and conditions. 

Visitors and users who violate the Terms and conditions may have their access and use of the Website suspended or terminated, at JobnLaw discretion. This Website is not for use by any person under the age of 13 years old and if under the age of 18 years old, this Website must be used under the supervision of a parent or any responsible adult.

Certain areas of this Website are restricted from access by you and JobnLaw may further restrict access by you to any areas of this Website, at any time, in its sole and absolute discretion.  Any user ID and password you may have for this Website are confidential and you must maintain confidentiality of such information.

Intellectual Property Rights.

You are granted a limited license only, subject to the restrictions provided in these Terms, for purposes of viewing the material contained on this Website.

In these Website Terms And Conditions, by uploading or sharing any content (which shall mean any audio, video, text, images or other material you choose to display on this Website), hereinafter identified as ‘Your content’, you grant JobnLaw a non-exclusive, worldwide, irrevocable, royalty-free, sublicensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media. In addition, by submitting, posting or displaying Your content which is intended to be available to the general public, you grant JobnLaw a worldwide, non-exclusive, royalty-free license to reproduce, adapt, distribute and publish such content for the purpose of promoting JobnLaw and its services.

Your content must be your own and must not be infringing on any third party’s rights. JobnLaw reserves the right to remove any of Your content from this Website at any time, and for any reason, without notice. JobnLaw reserves the right to refuse to accept, post, display or transmit any content in its sole discretion. JobnLaw is not responsible for any liability arising from the content you display on this Website.

Additional terms applicable to Employers.

Employers are solely responsible for their postings on JobnLaw website. JobnLaw is not to be considered to be an employer with respect to your use of any JobnLaw service and JobnLaw shall not be responsible for any employment decisions, for whatever reason, made by any entity posting jobs on any JobnLaw website or service.

Postings on the Website have to comply with applicable local, national and international laws, including but not limited to laws relating to labor and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, and intellectual property.

Employers shall use the JobnLaw website and profiles in accordance with all applicable privacy and data protection laws.

Candidate profiles may also be made available through the Website depending on the decision of said Candidate or in any case where a potential Candidate decides to get in contact with an employer. JobnLaw does not make any representations regarding Candidates, Candidates profiles or information for evaluation by employers.

A posting on the website may not contain:

  • Any false, misleading or inaccurate information;
  • Any material or link that does not respect applicable laws or that is not intended to people under 18 years old or that JobnLaw may consider to be unrespectful of moral values;
  • A name, logo or trademark that is not the property of the employer without the consent of such owner;
  • Any location name not related to the posting;
  • An hyperlink not related to the posting;
  • More than one job or job description and one location at a time unless appropriate package is bought.

JobnLaw reserves the right to remove any job posting or content from the Website which in the reasonable exercise of JobnLaw discretion, does not comply with the Terms, or if any content is posted that JobnLaw believes is not in the best interest of JobnLaw.

Resume database – Candidate suggestion.

Resume database shall be used in accordance with all applicable privacy and data protection laws. Employers agree to not disclose any of the data from JobnLaw resume database to any third party, unless the user is a recruitment or staffing agency using a resume for employment purpose only. It is totally prohibited to an employer to do any other use of the resume database than as an employer seeking employees. Such prohibition includes, but is not limited to, make advertisment, promotion, unsolicited phone calls or send unsolicited emails.

Additional terms applicable to Job seekers (including internships seekers).

When a Job seeker registers on the JobnLaw website, such user is asked to create an account and provide certain information. Such user acknowledges and agrees being solely responsible for the accuracy of any information or material provided. JobnLaw reserves the right, and the job seeker gives JobnLaw, the right to offer third party services or products based on the preferences that are identified by the job seeker in the registration or at any time thereafter, and to receive information from JobnLaw or third party depending on any selection made or term agreed while registering or at any time thereafter.

Ownership. 

Employers and Job seekers understand and acknowledge that they have no ownership rights in their account on JobnLaw website. At any cancellation or termination of JobnLaw account, all information available, including postings, resumes, letters or saved jobs will be marked as deleted and may be deleted from JobnLaw databases and will be removed from any public area of the JobnLaw website. Information may continue to be available for some period of time because of delays in propagating such deletion through web servers. In addition, Employers and Job seekers understand and acknowledge that even when deleted, third parties may retain saved copies of any information provided. Also, Employers and Job seekers understand that JobnLaw reserves the right to delete inactive accounts with all information after a certain period of time.

No Warranties.

This Website is a plarform provided “as is,” and JobnLaw makes no express or implied representations or warranties, of any kind related to this Website or the third party content contained on this Website. Additionally, nothing contained on this Website shall be construed as providing consult or advice to you.

Limitation of liability.

In no event shall JobnLaw nor any of its officers, directors and employees, be liable to you for anything arising out of or in any way connected with your use of this Website, whether such liability is under contract, tort or otherwise, and JobnLaw, including its officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

Indemnification.

You hereby indemnify to the fullest extent JobnLaw from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these Terms.

Severability.

If any provision of these Terms  is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

Governing Law & Jurisdiction.

These Terms will be governed by and construed in accordance with the laws of the Province of Quebec, Canada, and you submit to the non-exclusive jurisdiction of the province and provincial and federal courts located in Quebec for the resolution of any disputes.
